These Terms and Conditions are applicable with effect from 28th March 2024.
We4Her Foundation (“we” or “our” or “us” or “We4Her”) is an non- profit organization duly established under the Indian Trust Act, 1956 having its registered offices at C-5, Arjun Marg, Defence Colony, New Delhi 110024, working in the areas of gender justice and gender equality.
These Terms and Conditions apply inter alia to persons who visit We4Her’s website or other electronic platform (“We4Her Platform” or “Platform”), persons who contact third parties to avail legal services via the We4Her Platform, persons who provide us information or otherwise participate in any programs, conferences, seminars or research activities that We4Her undertakes, and lawyers or their representatives who provide We4Her with their details for publication on the We4Her Platform (“you” or “your” or “User(s)”).
These Terms and Conditions and our Privacy Policy available at form a legally binding and enforceable contract between you and We4Her. We may update these Terms and Conditions and the Privacy Policy from time to time and encourage you to review these documents routinely before accessing our services. If you do not agree to these Terms and Conditions and Privacy Policy, please exit the We4Her Platform immediately and discontinue any use of the information or services obtainable or accessible through our Platform.
By clicking “I Agree” or otherwise using the Platform, you acknowledge that you:
(i) are legally competent to avail of our services and have the right, authority, and legal capacity to enter into this arrangement;
(ii) have read, understood, and are bound by these Terms and Conditions, and if you represent a person or entity, you confirm and represent that you have the necessary power and authority to bind such person and/or entity to these Terms and Conditions and our Privacy Policy; and
(iii) are not in violation of any applicable laws through your use of our Platform and services.
If you wish to avail our services, you are required to register on our Platform and in some instances fill out forms or questionnaires, as may be provided by us. In order to register for our services, you are required to provide us with certain information. Such information will be used and processed in accordance with these Terms and Conditions and our Privacy Policy. You represent and warrant that any and all required information that you submit or provide while accessing or using our Platform or services is accurate and true.
In connection with your use of our Platform or services, you hereby agree:
(i) to be honest and behave in a professional and civil manner in your interactions with other users via our Platform; and
(ii) not to use our Platform or services for any harmful, illegal, or nefarious purposes or use our Platform or services in a manner that is harmful to other users.
You also agree and acknowledge that We4Her does not exercise any control over the conduct of and interactions between users of our Platform and services, and you will be solely responsible for all such interactions. We4Her is not a legal service provider and does not render legal advice. Your use of our Platform and the information made available on it in any manner does not create an attorney-client relationship between you and We4Her. If you reach out through our Platform to a legal service provider, the attorney-client relationship is purely between you and the legal service provider, with no role of We4Her in the same. Conversely, if you are a legal service provider, We4Her has no responsibility for the acts or omissions of any actual or potential client who approaches you using the We4Her Platform. We4Her merely provides a facilitative electronic platform as an intermediary. Any decisions, arrangements, relationships or transactions during the course of availing or providing legal services, as the case may be, via the We4Her Plartform is conducted and concluded directly between the legal service provider and the clients who have availed their legal services, without the involvement of We4Her.
We4Her reserves the right, but not an obligation, to investigate or inspect any possible violations by users of these Terms and Conditions, or applicable law. Following such investigation/inspection, We4Her may, in its sole discretion, take any action it deems fit, including termination of services rendered to the users.
We4Her hereby disclaims all implied representations, warranties, or guarantees as to the accuracy, validity, reliability or completeness of any information and material on our Platform. All information available on our Platform are provided for general information and educational purposes only and should not be relied upon as legal advice or used as the basis for making decisions. Any reliance on the information available on our Platform is at your own risk.
We4Hermay partner with various thirdparties, including lawyers and law firms, to provide you with requisite services. These third parties shall always be solely liable and responsible for the services provided by them, and their terms and conditions, if any, will apply in such cases.We4Her shall not be responsible for and does not guarantee the quality, efficiency or suitability of the services provided by third parties.We encourage you to review their terms and conditions, or otherwise consult the third-party, as required.
The legal service providers who have registered with We4Her and whose information is available on the We4Her Platform are not employees, agents or representatives of We4Her in any form, and any legal advice, assistance or services rendered by such legal service providers is independent of We4Her’s supervision, overview, control or involvement of any kind. Publication of the information of the legal service providers on the We4HerPlatform does not amount to a referral, recommendation, warranty, guarantee or endorsement of any kind.
You acknowledge that We4Her merely offers an online directory of legal service providerswho are interested in offering their services on theWe4HerPlatform. You agree and acknowledge that We4Her is not responsible for any acts, omissions, decisions, arrangements, relationships or transactions you enter into with such other users of the We4HerPlatform.
You agree and acknowledge that any decisions, arrangements, relationships or transactions during the course of availing or providing legal services, as the case may be, viathe We4HerPlatform shall be conducted and concluded directly between the users, without the involvement of We4Her.
You agree and acknowledge that We4Her shall not be responsible for any losses or damages incurred by you in relation to your use of our Platform or services. The use thereof is at your sole risk, and you shall assume full responsibility for any costs and expenses associated therewith.
THE SERVICES ARE PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED. WE4HER DOES NOT WARRANT THAT THE PLATFORM AND SERVICES PROVIDED WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THE PLATFORM OR ITS HOSTING SERVER ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. FURTHER, YOU ACKNOWLEDGE THAT ON OCCASION, THE PLATFORM MAY BE TEMPORARILY DOWN DUE TO PERIODIC MAINTENANCE, TECHNICAL ISSUES, OR FOR ANY SECURITY REASONS BEYOND WE4HER’S CONTROL. IN SUCH INSTANCES OF DOWNTIME, WE4HER SHALL NOT BE HELD LIABLE FOR ANY LOSSES WHICH YOU MAY INCUR. HOWEVER, WE4HER SHALL MAKE BEST EFFORTS TO RECTIFY THE ISSUES CAUSING THE DOWNTIME AND MAKE THE PLATFORM AVAILABLE AT THE EARLIEST.
The We4Her Platform and services may contain or use copyrighted material, trademarks, and other proprietary information that belongs to We4Her or its licensors, and you agree not to use or otherwise reproduce separately, We4Her ’s proprietary rights and the textual content associated with them without obtaining We4Her ’s prior written consent. You agree not to remove, obscure, or otherwise alter any proprietary notices appearing on any content on the Platform, including copyright, trademark, and other intellectual property notices.
You may be permitted to upload, transmit through, or otherwise make available through our Platform, certain information, content or other materials, such as providing a description of your dispute or legal concerns(collectively User Content).
You confirm and undertake that you will not display, upload, publish, transmit, update or share any User Content that:
(i) belongs to another person and to which you do not have any right;
(ii) is obscene, pornographic, pedophilic, invasive of another's privacy, including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or an online game that causes user harm, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
(iii) is harmful to children;
(iv) infringes any patent, trademark, copyright or other proprietary rights;
(v) deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature or, in respect of any business of the Central Government, is identified as fake or false or misleading by such fact check unit of the Central Government as may be notified/specified;
(vi) impersonates another person;
(vii) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation;
(viii) contains software viruses or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;and
(ix) violates any law for the time being in force.
You agree that you are solely liable for any damage or harm resulting from User Content that you submit or upload on our Platform.
has the right, but not the obligation, to monitor User Content. We4Her has the right, in its sole discretion and for any reason whatsoever to edit, refuse to post, remove, or disable access to any User Content.
The We4HerPlatform may provide links or display media of third parties or redirect you to other websites, services or resources (Third Party Sites). We4Her has no control over such Third Party Sites and We4Her is not responsible for such Third Party Sites. You further acknowledge and agree that We4Her will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, events, goods, or services available on or through any Third Party Sites.
To the fullest extent permitted by applicable law, you hereby expressly agree to defend, indemnify, and hold harmless We4Her, its affiliates, officers,agents, and successors and assigns, against any and all claims, liabilities, damages, losses, costs and expenses, including reasonable attorney's fees, caused by or arising out of claims based upon any breach by you of these Terms and Conditions or applicable law.
In no event shall We4Her be liable to compensate you or any third party for any direct, indirect, special, incidental, consequential, or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable, and whether or not you have been advised of the possibility of such damages, based on any theory of liability, including breach of contract or warranty, negligence, or other tortious action, or any other claim arising out of or in connection with your use or subscription of or access to ourPlatform or services.
You agree that We4Her may, in its sole discretion, suspend or terminate your use or access to our Platform or services for any reason, including without limitation, if We4Herbelieves that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions or applicable law. We4Her may also, in its sole discretion, and at any time discontinue the provisions of services, or any part thereof, with or without notice. You agree that We4Her will not be liable to you or any third party for termination of your access to our Platform or services.
You agree that no action of We4Her, other than an express written waiver or amendment, may be interpreted as a waiver or amendment of any of these Terms and Conditions. In the event any clause of these Terms and Conditions is found to be unenforceable, then whenever possible, this will not affect any other clause, and each shall remain in full force and effect.
These Terms and Conditions will be governed by and construed in accordance with the laws applicable in India and any dispute arising out of or in connection with these Terms and Conditions or services shall be subject to the exclusive jurisdiction of the courts of New Delhi India.
